There is a specific set of protocols that officers who administer Alcotest Breathalyzers and sobriety checks must follow in order for the test results to be admissible in court. In terms of breath tests, the officer must honor a 20 minute observation period before administering the test to ensure the driver does not burp, regurgitate, ingest anything, or engage in any other behavior that may compromise the results. If the officer does not observe the driver for 20 consecutive minutes, the results of the test may be ruled inadmissible.
