Challenging Breath Tests And Field Sobriety Checks
At the Reagan Law Offices, LLC, we are committed to protecting the rights of New Jersey drivers who were pulled over under suspicion of drunk driving and given breath tests and field sobriety checks. As has been demonstrated time and again, these tests are often unreliable and designed to make it very difficult for the test taker to pass, regardless of whether his or her blood alcohol level is over the legal limit.
A failed Breathalyzer or field sobriety test does not necessarily equal a conviction. Our lead attorney Brian Reagan has over 20 years of experience representing drivers charged with DUI and can help you challenge the results of these often inaccurate tests. Protect Your Rights And Keep Your License
There is a specific set of protocols that officers who administer Alcotest Breathalyzers and sobriety checks must follow in order for the test results to be admissible in court. In terms of breath tests, the officer must honor a 20 minute observation period before administering the test to ensure the driver does not burp, regurgitate, ingest anything, or engage in any other behavior that may compromise the results. If the officer does not observe the driver for 20 consecutive minutes, the results of the test may be ruled inadmissible. Likewise, our firm can also investigate the Alcotest machine to determine whether it is properly calibrated and giving accurate readings.
In terms of field sobriety tests, we can investigate to determine whether the officer was qualified to administer the test and if the test was done in a proper location. Further, we can find out whether the test taker has any underlying medical conditions that would inhibit the test. Through a combination of these and other strategies, our firm can protect your rights and challenge your Breathalyzer and field sobriety test results.
